Despite weaponizing the justice system to try and defeat Donald Trump, Biden is finding out some bulwarks of constitutional integrity still remain in the system.
And Jack Smith just lost a big fight in court that’s got Donald Trump grinning from ear-to-ear.
Jack Smith attempts more election interference
Jack Smith’s meddling in the 2024 election on behalf of the Joe Biden re-election campaign has included demands that judges allow him the right to limit Donald Trump’s political rhetoric.
Obama Judge Tanya Chutkan granted Smith an unconstitutional gag order in the January 6th case that allowed Joe Biden’s Justice Department to stifle Donald Trump’s speech on the campaign trail under the threat of jail time.
Jack Smith was hoping to pull the same stunt in the Mar-a-Lago documents case.
Just before the Memorial Day weekend holiday, Smith sprung a surprise attack demanding Judge Aileen Cannon impose an unconstitutional gag order on Trump.
What triggered Smith’s tyrannical attempt to silence Biden’s general election opponent was an email Trump sent out to supporters blasting Joe Biden’s Justice Department for devising a plan to use lethal force as part of the August 22, 2022 raid on Mar-a-Lago.
Trump’s lawyers also blasted the surprise filing as blatantly unlawful as Smith “willfully disregard[ed] required procedures” about conferring with the defense before filing such a motion.
The defense slammed the move as “bad-faith behavior” on Smith’s part by filing the gag order request just before a holiday weekend.
Judge Cannon denies Smith’s unlawful gag order
But Judge Cannon is quickly losing her patience with Smith and his political dirty tricks.
Cannon rejected the gag order request with a brutal dismissal.
“[T]he Court finds the Special Counsel’s pro forma ‘conferral’ to be wholly lacking in substance and professional courtesy,” Cannon stated.
“It should go without saying that meaningful conferral is not a perfunctory exercise,” Judge Cannon continued.
Judge Cannon also put Smith on notice that he needed to follow the rules in any future filings and, unlike the friendly Democrat judge in the other federal case, she wasn’t going to permit Smith to cut corners just because of Biden’s great desperation to jail Trump before the election.
“Because the filing of the Special Counsel’s Motion did not adhere to these basic requirements, it is due to be denied without prejudice. Any future, non-emergency motion brought in this case — whether on the topic of release conditions or anything else — shall not be filed absent meaningful, timely, and professional conferral,” Cannon added.
Cannon even warned Smith that he could face sanctions if he were to try any more funny business.
“Failure to comply with these requirements may result in sanctions,” Cannon added.
The one weakness in Joe Biden’s lawfare campaign against Donald Trump are fair judges.
The Supreme Court paused the January 6th prosecution to sort out Trump’s claims of Presidential immunity.
Judge Cannon first thwarted Smith’s efforts to meddle in the election by slowing down his politically motivated demand for a speedy trial.
Now Judge Cannon blocked his unconstitutional ploy to clamp down on the political speech of Joe Biden’s election challenger – Donald Trump.
