Conservatives have a majority on the Supreme Court.
But that may not last for much longer.
And now Donald Trump may lose the Supreme Court because of this sneak attack.
Joe Biden set a trap for Donald Trump and conservatives on the way out the door.
Biden seized Putin-like dictatorial authority to declare the Equal Rights Amendment ratified as the 28th Amendment to the United States Constitution.
“Today I’m affirming what I have long believed and what three-fourths of the states have ratified: The 28th Amendment is the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex,” Biden wrote on X.
Feminists held this out as their dream goal since Congress passed it in 1972.
But 38 states failed to ratify by the deadline in 1982.
Virginia ratified in 2020.
However on December 17, 2024, the archivist of the United States affirmed that the deadline passed and she couldn’t certify the Equal Rights Amendment as ratified.
Without the archivists certification, an amendment isn’t ratified.
There is a process for amending the Constitution.
Nowhere does this process include the President deeming an amendment ratified by executive fiat on social media.
And right after Joe Biden’s lawless order, two pillars of the leftwing legal establishment weighed in with their support.
The American Bar Association – which vets candidates for judicial nominations and rates them as qualified or not – put out a statement falsely claiming that the Equal Rights Amendment met the criteria to be considered part of the Constitution.

Georgetown law professor Victoria Nourse shamed herself by releasing a statement affirming that the Equal Rights Amendment was ratified to the Constitution.

The American Bar Association and professor Nourse adding their support to Biden’s lawless power grab now gives liberals a branch to cling to when some Democrat state attorney general invariably tries to enforce the provisions of the Equal Rights Amendment forcing the Supreme Court to step in and smack them down.
When that happens, Democrats will scream and cry about how the conservative majority on the Supreme Court are political gangsters running roughshod over the Constitution.
That will build momentum on the left to pack the Supreme Court and create a permanent leftwing majority the next time Democrats control the Presidency and both Houses of Congress.
