Trump Lawyers File Motion For Judge In Civil Fraud Case To Recuse Him

The lawfare against Donald Trump isn’t over.

It’s running parallel to the campaign.

And Alina Habba just made sure Letitia James had one very bad day.

Donald Trump is appealing Democrat Judge Arthur Engoron’s absurd $464 million judgment in a civil fraud suit brought by Democrat New York Attorney General Letitia James.

Engoron hit Trump with the nearly half-billion fine despite there being no evidence anyone was actually defrauded.

James and Engoron just made up the idea that Trump was guilty of being a fraud despite his lenders making money and no crimes being committed.

Engoron is still overseeing a monitor he put in place to manage the Trump Organization and Trump’s lawyers want him to recuse himself while they appeal a fine that clearly violates Trump’s Eighth Amendment right against oppressive fines.

The appeal centers on a May NBC4 article quoting attorney Adam Leitman Bailey who revealed that he had a private conversation with Judge Engoron about the case in the hallway of the courthouse.

“I actually had the ability to speak to him three weeks ago,” Bailey told NBC4.

“I saw him in the corner [at the courthouse] and I told my client, ‘I need to go.’ And I walked over and we started talking… I wanted him to know what I think and why… I really want him to get it right,” Bailey added.

Trump’s lawyers not being present for such conversations is a violation of Trump’s due process right to a fair trial.

“Specifically, this Court has been publicly accused of engaging in prohibited communications regarding the merits of this case, in clear violation of the Code and this Court’s solemn oath,” the recusal motion read.

“Where, as here, this Court’s impartiality might reasonably be questioned under the circumstances, it must recuse. Indeed, there is no other means of dispelling the shadow that now looms over this Court’s impartiality, fairness, and ability to adhere to the Code,” the motion added.

“According to Mr. Bailey, this Court was an active participant in a conversation concerning the merits of the case, wherein this Court asked Mr. Bailey a ‘lot of questions,’” the motion concluded.

Alina Habba wrote on social media that Judge Engoron’s conduct was a clear-cut violation of the New York Code of Judicial Conduct and that Engoron must recuse himself.

“The New York Code of Judicial Conduct exists to ensure that litigants are afforded a fair and impartial trial. Justice Engoron’s communications with Attorney Adam Leitman Bailey regarding the merits of this case, however, directly violate that code and demonstrate that Judge Engoron cannot serve as a fair arbiter. It is clear that Judge Engoron should recuse himself immediately,” Habba posted.

Democrats keep suing and indicting Trump in New York because judges are elected and Democrat prosecutors like James and Alvin Bragg know they can count on a biased judge to rig the case to guarantee a verdict against Trump.

But will the higher courts – whose judges aren’t elected in Manhattan where Democrats outnumber Republicans nine to one – allow this corruption of justice to continue?
