Democrats initially began a redistricting war that began with a lawsuit that forced Texas to engage in mid-decade redrawing of the state’s Congressional map.
Republicans drew a new map that netted five Republican seats.
Missouri and North Carolina followed suit with maps that added one new GOP seat apiece.
These new maps took on such great importance because Democrats only needed to win back five seats to retake the majority in the House of Representatives.
Republicans gaining new seats added a cushion that Democrats may not be able to overcome.
But then rogue judges stepped in.
A three-judge Texas panel ruled Texas illegally redrew its map along racial lines.
“The map ultimately passed by the Legislature and signed by the Governor — the 2025 Map — achieved all but one of the racial objectives that DOJ demanded,” the majority opinion read.
Texas immediately appealed to the Supreme Court, and Governor Greg Abbott blasted the judges’ baseless claims of racial discrimination.
“Any claim that these maps are discriminatory is absurd and unsupported by the testimony offered during ten days of hearings,” Abbott declared. “This ruling is clearly erroneous and undermines the authority the U.S. Constitution assigns to the Texas Legislature by imposing a different map by judicial edict.”
The ruling also throws the 2026 elections into chaos as candidates made decisions on which districts to run in based on the new maps.
And the filing deadline is on December 8, which leaves little time to draw a new map.
“Simply put, the 2026 congressional election is not underway,” the opinion continued. “In any event, any disruption that would happen here is attributable to the Legislature, not the Court. The Legislature—not the Court—set the timetable for this injunction. The Legislature—not the Court—redrew Texas’s congressional map weeks before precinct-chair and candidate-filing periods opened. The State chose to ‘toy with its election laws close to’ the 2026 congressional election, though that is certainly its prerogative.”
Thanks to this ruling, Democrats may now be the ones gaining seats in redistricting.
