And Alina Habba wrote one letter that blindsided Donald Trump.

Obama Judge Matthew S. Brann ruled that Alina Habba’s appointment as Acting U.S. Attorney for New Jersey was unconstitutional because she stayed in the position after the 120-day clock ran out.
“The Executive branch has perpetuated Alina Habba’s appointment to act as the United States Attorney for the District of New Jersey through a novel series of legal and personnel moves,” Brann wrote.
Because of that, any indictments Habba brought were void.
Brann added that Habba “has exercised the functions and duties of the office of the United States Attorney for the District of New Jersey without lawful authority since July 1, 2025,” and thus “[h]er actions since that point may be declared void…[a]nd because she is not currently qualified to exercise the functions and duties of the office in an acting capacity, she must be disqualified from participating in any ongoing cases.”
The 120-day clock ran out on Habba because the Senate – even though it is under GOP control – refused to hold a confirmation vote on Habba due to New Jersey’s Democratic Senators blocking her via the body’s “blue slip” rule, which allows any Senator to block a home-state nominee.
Blue slips give Democrats a veto over any Trump judicial or U.S. Attorney nominee, even though Republicans have the majority.
Democrats blocked nominees like Habba because Habba would end the weaponization of the justice system and its double standard, such as when she brought criminal charges against Democrat Congresswoman LaMonica McIver for allegedly assaulting law enforcement when she shoved her way into an ICE facility.
As a result of the ruling, Habba announced she was resigning as acting U.S. Attorney for New Jersey.
Habba blamed the blue sip for her decision.
“While I was focused on delivering real results, judges in my state took advantage of a flawed blue slip tradition and became weapons for the politicized left. For months, these judges stopped conducting trials and entering sentences, leaving violent criminals on the streets. They joined New Jersey senators, who care more about fighting President Trump than the well-being of residents, which they serve,” Habba wrote in a statement posted to social media.
“As a result of the Third Circuit’s ruling, and to protect the stability and integrity of the office which I love, I have decided to step down in my role as the U.S. Attorney for the District of New Jersey,” Habba added.
Habba said just because she was complying with the ruling doesn’t mean she was surrendering to left-wing judicial tyranny, as she plans to appeal the decision.
“But do not mistake compliance for surrender. This decision will not weaken the Justice Department, and it will not weaken me,” Habba added.
Habba also revealed she wasn’t leaving the Trump administration as she “will continue to serve the Department of Justice as the Senior Advisor” to Attorney General Pam Bondi, “[a]s we wait for further review of the [court’s] ruling.”
